Terms of purchase

General terms of purchase

These general terms and conditions (the "Terms") apply when you or the company you represent (the "Customer") places an order from us via www.Dykmarknad.se (the "Website"). Agreements are entered into in Swedish between the Customer (i.e. you or the company you represent) and Handelsbolaget Wikrian 969788-0103. ("Dykmarknad"). The terms apply to both consumers and companies. Note that in some parts the terms differ depending on whether you place your order as a consumer or as a representative of a company.


You who shop as a private person need to be over 18 years of age, not be under guardianship and otherwise have the capacity to enter into agreements.

You who act as a representative of a company must have, and hereby guarantee that you have, authority to enter into agreements and make purchases for the company you represent, i.e. Customer, bill.


Agreement and order

Orders can be made via the Website and in connection with this you accept the Terms. Orders placed via fax, e-mail or telephone can unfortunately not be processed. When ordering, Dykmarknad sends as soon as possible an order confirmation to the Customer who confirms the order and an agreement between you and Dykmarknad has thus been entered into. Diving Market has the right in individual cases to refuse or change the order (for example, if the Customer has provided incorrect personal information).


Product information etc.

Dykmarknad reserves the right to final sale of products and any image and writing errors on the Website, in advertisements or other marketing material, such as errors in product description or technical specification as well as incorrect prices or incorrect information regarding whether a product is in stock.


Diving Market has the right to correct any possible errors, change or update the information on the Website and to continuously make product changes and improvements. Please note that Dykmarknad never lists products that are temporarily out of stock. Products that are temporarily out of stock must be re-ordered at another time.


Images of products on the Website, in advertisements and other marketing material shall be seen as illustrations only.


The information on the Website is protected by, among other things, intellectual property law and market law. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content may not be copied or used without prior written consent from Dykmarknad.


Prices

When ordering, the prices that are stated on the Website at the time of ordering apply, unless otherwise expressly agreed or if the circumstances obviously cause otherwise. Diving market prices are stated in Swedish kronor (SEK) and include applicable VAT. Any payment and shipping fees are stated separately. Prices are reported both before the order and in the order confirmation.


The Dykmarknad is not bound by such incorrect pricing that the Customer realized or should have realized. If an incorrect price has been entered for a product that the Customer has ordered, we will notify you and await your approval of the corrected price before the purchase is completed. Diving market reserves the right to make typing errors and price changes due to changes in VAT, changes in the currency situation, purchase prices and changes in statutory fees.


Product availability

Some products can be delivered directly from the manufacturer or distributor, this means that the customer may receive several deliveries for an order, and that delivery times may vary depending on product availability, as well as distance for delivery and total weight for delivery.


Promotions and offers

Diving market can from time to time offer promotions and offers for various products. For products included in such promotions, the more favorable price or the more favorable conditions apply during the period specified on the Website or as long as the stock lasts. Promotions and offers cannot be combined with other discounts as long as it is not explicitly stated. Diving Market reserves the right to withdraw such promotions at any time. Upon termination or revocation of a promotion, these Terms apply without modification.


Payment

The customer can pay for his purchase through the available payment options listed on the Website. Diving Market reserves the right not to always offer all payment options. If such a restriction on payment options exists, it is stated on the Website. In the event of non-payment for the ordered order, Dykmarknad reserves the right to cancel the order after 7 days, without notifying the customer.


Even if the price is displayed in another currency, payment is always made in SEK.

Delivery and transport

Diving Market only delivers products to addresses in selected countries in Europe. The cost of shipping will be added to the order unless otherwise expressly stated. More information about shipping options can be found below. Please note that restrictions on delivery options may apply 

Unredeemed delivery
The customer is obliged to redeem, pick up or receive their delivery in accordance with the instructions provided from time to time by Dykmarknad or by the shipping company. Depending on the Customer's choice of delivery option, the Customer receives a notification showing where and when the package is to be picked up or received. For packages that are not redeemed, picked up or received, Dykmarknad has the right to charge a fee of SEK 150 for Dykmarknad's additional costs such as return shipping.

Right of withdrawal in distance trading
In distance selling, you as a consumer always have 14 days to cancel your purchase in accordance with current consumer law.

Right of withdrawal means that you as a consumer have the right to cancel your purchase by notifying us within 14 days of you or a person specified by you receiving the ordered product (the withdrawal period).

If you want to cancel your purchase, you must send a clear message to Dykmarknad about this before the withdrawal period has expired.
In such a message, you must state your name, address and other relevant information, e.g. order number, order date, e-mail address and which products you regret if the order contains several products. For smooth handling, we recommend that you fill out the return form on the Website. You can also choose to use the standard form for exercising the right of withdrawal that the Swedish Consumer Agency has produced.

When purchasing via the Website, you have the right to open the packaging and examine the product to the extent required to assess whether you are satisfied with it. If and to the extent that the product is handled to a greater extent than is necessary to determine its properties or function, Dykmarknad has the right to make a depreciation deduction on the amount to be repaid. The size of the depreciation deduction corresponds to the depreciation of the product compared to the original value of the product.

Certain products are excluded from the right of withdrawal. In connection with ordering a product for which the right of withdrawal does not apply, you will receive clear information about this on the Website. Products that are exempt from the right of withdrawal are e.g. products that have been manufactured in accordance with the Customer's instructions or that have otherwise been given a clear personal touch. Other products that are exempt from the right of withdrawal are products that with a broken seal cannot be returned due to health or hygiene reasons and the seal has been broken by the consumer, e.g. underwear and hygiene items. Diving suits and underwear are not considered underwear, as it is requested to use underwear in these products.

When exercising the right of withdrawal, the product must be sent to Dykmarknad within 14 days from the date you notified Dykmarknad that you regret it.
When the Customer regrets his purchase, the Customer pays the cost of return shipping.
The return must be sent directly to Dykmarknad and not via a representative, returns sent to a representative will not be picked up and will be returned to the sender.

The Customer is responsible for the condition of the product after the Customer has received the product and during return shipping. Diving Market therefore recommends that the product is sent in the original packaging well packaged in an outer packaging with a traceable shipment.

Diving market pays back the amount as soon as possible, including a fee for payment methods and shipping costs. If the right of withdrawal refers to only part of an order, Dykmarknad does not refund the fee for payment methods and shipping costs. Diving market has the right to make a depreciation deduction from the amount and make a deduction when buying return shipping as above. Refund will be made no later than 14 days from the date Dykmarknad received your notification that you regret it. However, Dykmarknad may wait with the refund until Dykmarknad has received the product or the Customer has shown that the product has been returned.
The refund is made via the payment alternative that the Customer chose when ordering, unless otherwise expressly agreed.

Open purchase
In addition to the statutory right of withdrawal in e-commerce, Dykmarknad gives all Customers an open purchase for 14 days from the time of purchase. In order for a product to be returned via Open Purchase, the product must be returned in unopened original packaging and be in the same condition as at the time of purchase. The customer must be able to present a valid proof of purchase in the form of an invoice, receipt or receipt copy.

Guarantee
To invoke the guarantee, the relevant proof of purchase, invoice, receipt, delivery note, etc. must accompany the complaint. The guarantee does not cover costs for repairs at another workshop, unless otherwise agreed in advance with Dykmarknads Kundservice. Please note that special warranty conditions may apply to products from other suppliers and manufacturers.

The warranty covers defects caused by material or manufacturing defects. Such an error that appears within the warranty period shall be deemed to have existed at the time of purchase. Wear, incorrect use and consumables such as light bulbs, cast nozzles and O-rings are not covered by the warranty. Without prejudice to your rights under the law, Dykmarknad reserves the right

Right of complaint
When ordering via the Website, the Customer always has a right of complaint from the day the Customer receives the product. Customers who wish to make a valid defect in the product must contact Dykmarknad as soon as possible after the defect was discovered. In order for the complaint to be valid, it must be made within a reasonable time after the Customer has noticed or should have noticed the error. A complaint made within one month of the error being discovered is always considered to have been made within a reasonable time.

The customer must inspect the products when they are received and any damage to the packaging must be reported directly to the forwarder or delivery point.

In the case of Complaints, we recommend that return forms on the Website are filled in and physically included in the shipment that is returned. This means that we can handle the return more quickly and make a possible refund.

The Customer is responsible for the condition of the product after the Customer has received the product and during return shipping. Diving Market recommends that the product is sent in its original packaging and that this is packed well in an outer packaging with a traceable shipment.
Remember that the Customer must keep costs down as much as possible.
Diving market does not redeem products that are returned against cash on delivery or cash on delivery.

When Dykmarknad has received the complained product and established that the complaint is valid, Dykmarknad will compensate the Customer in accordance with applicable legislation. This means that the error will be corrected or a new product will be sent. If this is not possible or if Dykmarknad otherwise deems it cost-effective, a refund may be made instead. If the Customer has borne the return shipping cost, it will also be refunded if the complaint is approved. Please note that Dykmarknad has the right to refuse the complaint if it turns out that the product is not faulty in accordance with current legislation and that Dykmarknad in such a case does not reimburse any expenses for return shipping.

If Dykmarknad is to repay the purchase amount, it will be done without undue delay after the complaint has been approved, but no later than within 14 days. The refund is made via the payment option that the Customer chose when ordering. We often handle the complaint directly and send out a new product or refund the purchase amount if the complaint is valid. Please note that any shipping fees paid will not be refunded. For slightly more complex products or assessments, we normally need more time to examine the product.

If the complaint is not valid in accordance with applicable law and therefore is not accepted, the Customer shall, at the request of Dykmarknad, pay an examination cost. If the Customer chooses not to take the product back or if the Customer chooses to repair the product at Dykmarknad at his own expense, no examination cost will be charged.

Return product
When returning for Ånger or Öppet köp, you are the customer for the return shipping. Please note that any shipping fees paid will not be refunded.
Remember that you always bear the risk when transporting to the Dive Market.
Do not send via agent, returns sent to agents will not be picked up and will be returned to the sender.

The Customer is responsible for the condition of the product from the time the Customer has received the product until the product is back at Dykmarknad. Proof of purchase and the completed return form must be included in order for a return to be handled by Dykmarknad.

In the case of a Guarantee or Complaint case, we ask you to contact Dykmarknad Customer Service and they will help you arrange transport for investigation.

Customer information and customer account
The Customer confirms that the personal information provided by the Customer in connection with the order is correct and completely filled in and is responsible for such information that is incorrect. Diving Market is responsible for personal data for the processing of personal data provided by the Customer in connection with the order. Information on how Dykmarknad processes the Customer's personal data can be found in Dykmarknad's privacy policy.

You, who are a registered Customer, undertake to ensure that no one other than yourself can use your login information. You may not disclose the username and password of any unauthorized person and must ensure that documents containing username and password information are stored in such a way that unauthorized persons cannot gain access to the information. You must immediately report to Dykmarknad if it can be suspected that someone unauthorized knows the Customer's password.

Customer who is a company guarantees that the person who has registered the customer account and any other users are authorized to perform measures and make purchases on behalf of the Customer on the Website. Customer who is a company is responsible for all actions performed by its users during login to the Customer's customer account. Furthermore, the Customer who is a company must ensure that its users read and accept these Terms and read Dykmarknad's privacy policy.

If Dykmarknad suspects that login information or a customer account is being misused or if using otherwise violates the Terms, Dykmarknad has the right to shut down the Customer and / or you as a user. Diving Market also has the right to assign you new login information for any reason. If the order is made in another person's name without their consent, the incident will be reported to the police.

Amendment of the Terms
Diving Market has the right to make changes to these Terms at any time. All changes to these Terms will be posted on the Website. Changes apply from the time the Customer has accepted the Terms
(in connection with a new purchase or when visiting the Website), alternatively 30 days after Dykmarknad has informed the Customer of the changes.

Applicable law and court
These conditions shall be interpreted in accordance with Swedish law and, notwithstanding what is stated in the paragraph below, shall be decided in Sweden by a general court.

Anyone who is a consumer can contact their municipality's consumer guidance or the Swedish Consumer Agency's information service "Hello Consumer" to get advice and information. Anyone who is a consumer also has the right to turn to the General Complaints Board (ARN). ARN can be reached either via www.arn.se or by address Box 174, 101 23 Stockholm. In the event of a dispute, Dykmarknad follows ARN's recommendations. A consumer can also complain via the EU's online dispute resolution platform, which can be reached at https://ec.europa.eu/consumers/odr.

Delivery and Shipping

Delivery options
Our shipping is by DHL Freight. The options you have are displayed when you complete your purchase. Purchases made via Dykmarknad.se are only delivered within Sweden. We typically offer delivery to a delivery point or home delivery. Home delivery takes place during the day.

To the delivery point
Your package will be sent to the delivery point closest to the address you specified in your order. You will receive a notification via SMS or e-mail when the package has arrived at the delivery point. If your package weighs more than 20 kg, it cannot be sent to a delivery point, but must be delivered to your home.

Free shipping
For orders over SEK 1,500 / we offer free shipping in Sweden. For promotions or other specified occasions, other delivery prices may apply, according to the campaign or according to the shipping list.

We normally complete your order within 48 hours after you place your order in some cases, an order can be sent directly from the distributor or manufacturer of the product, then normally 2 to 5 working days will be added for the actual transport.

The delivery time can be extended slightly at unusually high order intake, for example at Christmas or for products that are manufactured after the order has been placed, Orders with many items or that are to be delivered to remote locations may take longer.

You can see where your package is by searching for your package ID on the carrier's website. You will receive the package ID in the order confirmation from us.

When you receive the goods
Shipments must be signed when they are picked up at the delivery point. The person to whom the order is addressed must therefore also collect it. Remember to bring identification. If the bidder picks up the delivery, the bidder must show his and the recipient's identification. For home delivery, the order must be signed when it is received. The person who receives the goods must show their identification, and the customer's identification.

Your responsibility when you receive the goods
Please note that you are responsible for the goods when you have signed the delivery note.
If the packaging appears to be damaged, do not receive the package.
You are responsible for checking the goods and detecting any defects, and you must notify us of any complaints.
We recommend that you inspect the products when you receive them and that you report any damage to the packaging directly to the forwarder or delivery point and record these on the shipping documents.
If you first discover the damage when you return home, unpacking of goods (hidden damage) is reported no later than 14 calendar days after receipt of the goods.

Delivery not received / unredeemed order
If you have chosen to have your package to a delivery point, your package will remain there for 14 days. If you have not picked it up within this time, the package will be returned to Dykmarknad.
If you have chosen home delivery and are not at home when the delivery arrives, you can pick up a new delivery attempt at the carrier's terminal or pay for it yourself. The carrier will contact you. If all home delivery attempts fail, your package will be returned to the Dive Market.
For undelivered delivery / unredeemed order, we charge a fee of SEK 150. If the order value is below SEK 150, we deduct the entire order value.

Refund
In the first place, the refund is always made on payment method used at the time of purchase.
